The following terms and conditions are relevant to casual users of the Mossfiel Hall, and must be abided by. All persons or groups hiring the hall will be provided with a copy of these terms and conditions. The Committee of Management reserves the right to alter or vary these terms and conditions as required, and with out notice to hirers.

.: MOSSFIEL HALL – TERMS AND CONDITIONS FOR USE

The Mossfiel Hall is managed on behalf of the Wyndham City Council by the Apex Mossfiel Hall Committee of Management Inc. (hereafter referred to as ‘the Committee’) These terms and conditions reflect current laws and also Council and Committee requirements.

>>>PRE-PAYMENT OF BOND AND HIRE FEE

The cost of hiring the Mossfiel Hall is $220. A refundable bond of $150 is also required to be paid. A booking fee of at least $50 must be paid to confirm your booking. Without exception, payment in full (total of $370) for the hire is to be made three (3) weeks prior to the date of hire. A Hirer will not be issued with keys, unless and until payment in full has been received. (All cheques should be made payable to APEX MOSSFIEL HALL C.O.M. Inc.)

>>> ADJUSTMENTS FOR HIRE RATES

The Committee reserves the right to adjust the Hire Rate at anytime and without prior knowledge or consent of the Hirer. In this event, the Hirer will be given the option of confirming the hire at the adjusted rate, or cancelling the hire.

>>> ISSUE OF KEYS TO HIRER

The hirer is to collect and return the key on the day of the function. Any hirer who is issued with a key to this facility, is thereby responsible for the security and safekeeping of the building, contents and surrounding yards. The Hirer is required to exercise due care in ensuring the security and safekeeping of the building, contents and surrounding yards and to take all normal and reasonable precautions.

>>> NOISE

Following complaints from a neighbour, the Wyndham Council has banned the use of amplified music during evening or night functions. This includes pre-recorded and live music. Breaches of this clause will be referred to Council and may result in prosecution under the relevant laws.

>>> OBSERVATION OF HIRE TIMES

The hirer is to observe the start and finish times for the hire. Saturday end time is regulated by Section 48A(5) of the Environment Protection Act.

  • Saturday 4.00pm – 12.00 midnight
  • Sunday 7.00 pm – 12.00 midnight

**The hall MUST be cleaned and vacated by this time.

>>> MAXIMUM CAPACITY

The main hall can accommodate functions with up to 100 persons.

>>> CONTACT PHONE NUMBERS

In emergency circumstances ONLY, the booking officer can be contacted on 9748 9787 during a function.

>>> CLEANING

The Hirer will be obliged to restore the facility to a clean and tidy condition after the function. The facility must be cleaned to the satisfaction of the Committee, otherwise, the Bond will be retained (in whole or part) to cover the cost of additional cleaning which is deemed necessary. Cleaning equipment can be found in the cupboard opposite the ladies toilets. Rubbish (excluding recyclables) must be placed in garbage bags and deposited in the rubbish bins (red lids) located at the recycling and rubbish station near the front of the hall. (Please supply your own garbage bags).

>>> RECYCLING

The Wyndham City Council and the Committee are committed to recycling. We encourage the Hirer to take all recyclables away with them at the completion of their hire.

>>> SMOKING

The Wyndham City Council encourages a no smoking policy in all its buildings. There is to be NO SMOKING in the playground at back of the hall. Ash trays are provided on the front veranda area of the hall.

>>> SUPPLY OF FURNITURE

The Hirer is permitted to use those tables, trestles and chairs which are available in the hall. However, if the furniture available is inadequate, the Hirer will be obliged to obtain sufficient additional items of furniture at NO COST to the Committee. The tables, trestles and extra chairs (orange) MUST be returned, NEATLY, to the storeroom opposite the gents toilets (DO NOT OBSTRUCT THE DOOR WAYS). The Blue chairs are to be neatly stacked against the wall in the main hall, in the area indicated.

>>> DECORATIONS

The Hall may be decorated for your function. Hooks have been fitted on the picture rail for your use. YOU MAY NOT USE STAPLES, DRAWING PINS OR MASKING TAPE. All decorations MUST be removed after the function.

>>> SALE OF ALCOHOL

Alcohol is NOT to be sold within the facility under any circumstances.

>>> CONSUMPTION OF ALCOHOL

Alcohol is NOT to be consumed within this facility by any person under the age of 18 years, unless that person is in the company of his / her parents, guardian or adult spouse.

>>> CONDUCT OF SALES

No hirer will be permitted to use this facility for the conduct of wholesale or retail sales, or for any other sale in whatever form that sale might be conducted.

>>> RIGHT TO REFUSE

The Committee reserve the right to exercise its discretion to refuse any hall hire proposal and / or hall hire agreement. The hall will not generally be hired for the purpose of teenage birthday parties or ‘after parties’. At least one person older than 18 years of age must be present at the hall during any function.

>>> FURNITURE AND FITTINGS AVAILABLE TO HIRER

  • Refrigerator
  • Small electric Stove
  • Hot water urn
  • Approximately 69 blue and 43 orange chairs
  • A variety of 6′ and 8′ tables
  • Broom, mop and bucket
  • B.Y.O. EVERYTHING ELSE, including garbage bags

>>> DAMAGE

The Hirer is required to notify the committee of any damage caused to the hall during the hire period.


.: BOND FORFEITING EVENTS

The hall will be inspected following your event, and an assessment made by the committee will determine the amount of your bond to be refunded. If the hall is found to be in a clean and tidy condition, with no damage and all terms and conditions have been complied with, a full refund of the bond amount will be made within two weeks of the hire date.

Decisions regarding the retention of any or all of the bond will be made by the Committee. Any queries or disputes regarding retention of any or all bond money should be addressed to the Committee. The Hall Booking Officer is an employee and not a member of the Committee.

DAMAGE

Should any damage be caused to the hall during the period of a hire, the bond will be retained until any damage caused is repaired. The cost of repair of the damage will be deducted from the bond.

CLEANING

If the hall is not left in a clean and tidy condition, the bond will be retained. The contract cleaners will be engaged to restore the hall to a clean and tidy condition. The cost of cleaning will be deducted from the bond.

HALL KEY

Loss of the key or a failure to return the Hall key prior to next being required will result in $50 being retained from the bond.

REAR YARD

The playground area at the rear of the hall may be used by the Hirer. However, the area is used as a playgroup area for young children and the playground equipment is not owned by the Committee. Any littering of the playground area (including bottle tops, cigarette butts etc.) will be viewed extremely seriously. The cost of repair or cleaning of the playground area will be deducted from the bond. The rear yard is a no smoking area.

FALSITY

If false or misleading information is provided to the Committee to hire the hall, the bond may be retained in full.

EXCESS COSTS

The hirer shall be responsible for and agrees to pay any costs in excess of the bond amount for cleaning or repair or any damage caused during the period of hire.
